Terms of Use

These Terms of Use (the "Terms") explain in plain language how to use the ByteFit service, an AI nutrition assistant. The service runs in a Telegram bot and a Telegram Mini App (the primary product, where the AI is already available today), in an iPhone app, and on the bytefit.ru website. Please read this document. By using the service, you agree to these Terms.

These Terms are supplemented by our other documents: the Public Offer (rules of the paid subscription), the Privacy Policy (how we process data), and the Refund Policy. If there is any conflict between these documents on a payment or subscription matter, the Public Offer prevails.

1. Acceptance of the Terms

Using the service means that you have read these Terms, understood them, and agree to comply with them. Your agreement is expressed through your actions (conclusive actions): launching the bot, registering, filling in your profile, starting to use features, or paying for a subscription.

How this works in the bot. On the first launch (the /start command), the bot shows a welcome message with links to these Terms, the Public Offer, and the Privacy Policy, and invites you to review them. By continuing to use the bot after that point (filling in your profile, sending meal entries, and so on), you confirm your agreement to these Terms and to the documents accepted together with them. If you do not agree with any provision, please do not use the service.

Free features and the trial period. Use of the free features and the free 3-day trial period is governed by these Terms and the Privacy Policy, accepted at first use. The Public Offer governs only the paid relationship and is deemed accepted at the moment you confirm a paid purchase.

These Terms do not cancel or limit any consumer rights guaranteed by the legislation of the Russian Federation.

2. Service operator

The ByteFit service is operated and provided by the individual entrepreneur Individual Entrepreneur Albert Akhmadiev (the "Operator", "we"). The Operator is also the personal data operator (controller).

Email is the primary channel for official requests and claims. That said, we accept valid requests received through other official channels too, namely support inside the bot and the support page. We do not reject a valid claim solely because of the channel you chose.

3. What the service is

ByteFit is an AI nutrition assistant. In the Telegram bot and the Mini App, the following are already available today:

  • logging meals by photo, voice, or text with AI estimation of calories and macros (protein, fat, carbs);
  • daily and historical nutrition summaries;
  • a user profile and personalized calorie and macro goals;
  • chat with an AI coach on nutrition questions (with a limit of about 50 messages per day);
  • creating and editing meal plans with the help of AI;
  • recipe suggestions and a weekly recap.

Some features are free, and some require a paid subscription. Details about plans and payment are in section 9 and in the Public Offer.

An important distinction in how data is stored: in the iPhone app, diary entries are stored on the device itself, while in the bot, entries are stored on secure servers. See the Privacy Policy for more details.

4. User age

The service is intended for users aged 14 and over. By starting to use the service, you confirm that you are at least 14 years old.

If a user is under 18, we recommend using the service with the knowledge and involvement of a parent or legal guardian, especially in matters of nutrition and payment.

5. Account and access

Your account in the bot and the Mini App is your Telegram account. No separate password is created on the service side: access is tied to your Telegram account.

  • Keep access to your device and your Telegram account safe, because it is the gateway to your data in the service.
  • Do not share access to the bot with third parties.
  • If you notice unauthorized use of your account, please write to us as soon as possible at bytefit.ai@gmail.com.

Actions taken through your account are deemed to have been taken by you unless proven otherwise.

6. Rules of use

The service may be used for personal, non-commercial purposes and within the law. It is prohibited to:

  • obtain or attempt to obtain unauthorized access to the service, its servers, other users' accounts, or data;
  • decompile or disassemble the service, or otherwise try to extract its source code, unless expressly permitted by law;
  • use automated data collection (scraping), bots, or scripts for mass requests, create excessive load, or disrupt the service;
  • distribute malicious code or viruses, or otherwise harm the operation of the service and other users;
  • impersonate another person, the Operator, or its staff, or mislead others;
  • use the service for unlawful activity, infringement of third-party rights, or circumvention of these Terms.

If these rules are violated, we may restrict or terminate access to the service (see section 15).

7. Intellectual property

The service itself, namely the software of the bot and the Mini App, the design, interfaces, texts, graphics, the ByteFit name and logo, and other elements, belong to the Operator or are used by it on a lawful basis, and are protected by law.

We grant you a limited, revocable, non-exclusive, and non-transferable right to use the service for its intended purpose. This right does not grant you any rights to the service as an item of intellectual property and does not allow you to copy, modify, distribute, or create derivative products, unless permitted by law or by us in writing.

8. User content

"User content" is what you put into the service: nutrition diary entries, food photos, voice messages, text descriptions, profile data, and so on.

Your content stays yours. So that the service can work, you grant the Operator a limited, royalty-free, revocable license to use your content solely to provide and technically operate the service, for example, to recognize food, calculate calories and macros, generate summaries and recommendations, and answer your questions to the AI coach.

This license does not grant the right to use your content for training AI models or for any other processing not needed to provide the service to you. The license lasts for as long as it is necessary for the stated purposes.

Uploaded food photos and voice recordings are processed to extract nutrition data (or text) and are then not stored on our servers. The text of messages to the AI coach is also not stored (we keep only a usage counter). Details about the data involved and AI processing are in the Privacy Policy.

9. Subscription and payment

Some features are available by paid subscription. The full terms of sale (subject matter, prices, payment procedure, auto-renewal, refunds) are set out in the Public Offer, which is the main document on payments. Below is a short, plain-language summary.

9.1. Plans

The plans below are provided for reference, as of the last updated date, and may change. These figures are informational only.

The only binding purchase price is the amount shown to you in the bot immediately before you confirm payment. The reference figures above are illustrative and are not an offer at any specific price. Prices may change, but a price change never affects an already-paid period. Purchases are currently made inside the Telegram bot.

9.2. Payment methods

  • T-Bank (internet acquiring, RUB), for the initial payment and recurring renewals. Acquirer: JSC "TBank".
  • Telegram Stars (XTR), where the monthly subscription renews automatically and the yearly plan in Stars is a one-time purchase without auto-renewal.
  • Apple App Store, where in-app purchases in the iPhone app are handled separately under Apple's rules.

In-app purchases in the iPhone app (App Store). For purchases through the App Store, Apple acts as the merchant of record, and Apple's rules and refund procedures apply to them. These Terms and the Public Offer govern purchases made inside the Telegram bot via T-Bank or Telegram Stars.

Before paying via T-Bank, you provide a valid email (and in some cases a phone number). This is needed for the fiscal receipt under Federal Law No. 54-FZ, so correct contact details are a mandatory condition of payment, and you are responsible for their accuracy. Payment takes place on T-Bank's secure page, where you enter your card details. The full card number and CVV are not transmitted to or stored on our servers; we store only the masked card number and a payment token for recurring charges. In production, an electronic fiscal receipt is generated for each payment and sent to the email or phone number you provided.

9.3. Subscription auto-renewal

Card subscriptions (T-Bank) and the monthly Telegram Stars subscription renew automatically. Before the paid period ends, the cost of the next identical period is charged to your saved payment method at the price in effect at that time.

Separate consent to auto-charging. Before the first charge, the bot shows you the terms of recurring payments, namely the amount, the period, the fact that the card will be charged automatically without your involvement, and how to disable auto-renewal, and you must separately and explicitly confirm them in the bot. This confirmation is your consent to recurring payments, and the fact of confirmation is recorded (logged). Important rules:

  • Advance reminder. About 2 days before a renewal charge, we remind you about it (and about 2 days before the free trial period ends).
  • Disable at any time. You can disable auto-renewal at any time using the "Disable auto-renewal" button on the subscription screen in the bot, without contacting support.
  • Access continues until the end of the paid period. Disabling stops all future charges, but access is not revoked immediately; it remains in effect until the end of the already-paid term.
  • The card stays on file for convenience. The saved payment method remains linked so that you can re-subscribe later with fresh confirmation if you wish.
  • Failed charge. If a renewal charge does not go through, auto-renewal is automatically switched off, and there will be no repeated attempts.

The yearly plan in Telegram Stars does not renew automatically.

9.4. Refunds

Refunds are made in accordance with the legislation of the Russian Federation and our Refund Policy. You may cancel the service at any time (Article 32 of the Russian Law "On Protection of Consumer Rights"); a refund for the unused part of the paid period is made after deducting the expenses actually incurred by the Operator. This right is not limited in time.

For card purchases, refunds are generally processed through T-Bank upon your request to bytefit.ai@gmail.com; refunds are performed manually, without automatic proration. Full card details are not stored in the process; if a refund by the same method is impossible (for example, the card is no longer valid), we will agree on an alternative method with you. For purchases through Telegram Stars and the App Store, the procedure of the relevant platform applies. Details are in the Refund Policy.

10. Personal data and privacy

We process personal data in accordance with the legislation of the Russian Federation (including Federal Law No. 152-FZ) and our Privacy Policy, which is an integral part of our relationship with you and is incorporated into these Terms by reference.

Consent to the processing of personal data is given through a separate, standalone action at the moment such data is entered. To use AI features, where food data is transferred to a third-party AI provider outside the Russian Federation (cross-border transfer), your separate informed consent is required, and it is requested additionally before you use such features. Details are in the Privacy Policy.

Entering into the agreement and using the service are not conditioned on your consent to processing data beyond what is necessary to provide the service.

11. The service is not a medical service

ByteFit is informational and educational in nature. It is not medical care and not a medical service. The service does not diagnose, does not treat, and does not replace consultation with a qualified doctor or dietitian.

  • The information and recommendations in the service are intended for general guidance and self-education.
  • You make your own decisions about your nutrition and health and are responsible for them.
  • If you have any illness, are pregnant, have a food allergy, or have other health conditions, be sure to consult a doctor before changing your diet or starting a nutrition program.

The service is not intended to collect information about your state of health (diagnoses and the like); please do not enter such information. The service does not guarantee any results for your health, weight, or body shape.

12. Accuracy of AI estimates

Estimates of calories, protein, fat, and carbohydrates, dish recognition, meal plans, and AI coach answers are generated using artificial intelligence and are approximate. They may contain errors, including incorrectly identifying a dish or its quantity.

Please treat the results as guidance and check or correct them whenever accuracy matters to you. The Operator is not responsible for inaccuracies in AI estimates, within the limits set by section 13.

13. Limitation of liability

The service is provided on an "as is" and "as available" basis. We make reasonable efforts to keep it running stably and securely, but we do not guarantee that the service will operate without interruptions or errors or that it will fit all of your specific needs.

To the maximum extent permitted by law:

  • the Operator is not liable for indirect losses, lost profit, or the consequences of nutrition and health decisions you make based on the service;
  • the Operator is not liable for failures and limitations caused by third-party services (Telegram, Apple, T-Bank, AI providers, telecom operators) or by the user's own actions.

These limitations do not apply to cases where liability cannot be limited or excluded by law. We do not limit liability for intentional misconduct and do not limit consumer rights below the level guaranteed by the Russian Law "On Protection of Consumer Rights". In such cases, liability applies to the extent provided by law.

14. Third-party services

The service works together with third-party platforms, each of which has its own terms and policies:

  • Telegram, for message delivery and Telegram Stars payments;
  • Apple App Store, for in-app purchases in the iPhone app;
  • JSC "TBank", for accepting card payments and issuing fiscal receipts;
  • AI providers (including OpenAI), for processing food data and AI requests; their servers may be located outside the Russian Federation (the cross-border transfer is described in the Privacy Policy).

Use of these platforms is governed by their own rules. The Operator is not responsible for the operation and decisions of third-party services. At the same time, for subscriptions sold by the Operator itself (including those paid via Telegram Stars), the Operator remains the seller and is responsible for the service under the legislation of the Russian Federation.

15. Suspension and termination of access

We may suspend or terminate your access to the service in whole or in part if you violate these Terms, the law, or third-party rights, or if it is necessary for the security of the service and other users. Where possible, we will notify you in advance, unless doing so would hinder remedying the violation.

You may stop using the service at any time. Termination of access for a violation does not deprive you of your consumer rights regarding the already-paid period; refund matters are resolved under the Refund Policy.

16. Governing law and dispute resolution

These Terms and the relationship between you and the Operator are governed by the law of the Russian Federation.

If any disagreements arise, a mandatory pre-claim (pre-litigation) procedure applies first: send your request to bytefit.ai@gmail.com. We will review the claim and try to resolve the matter by agreement between the parties within 10 business days of receiving it.

If agreement cannot be reached, the dispute is referred to a court. A consumer retains the statutory right to bring a claim at their place of residence or stay (the Russian Law "On Protection of Consumer Rights"). Other disputes are heard by the court at the Operator's location (Kazan, Republic of Tatarstan, Russia).

17. Changes to the Terms

We may update these Terms. The current version is always published on the /en/terms.html page with the last updated date at the top. Changes apply going forward and do not worsen your position with respect to an already-paid period.

For an active auto-renewing subscription, each renewal is subject to the terms, price, and scope that were in effect at the time of your initial confirmation. Any change that worsens your position or increases the price does not take effect automatically and requires your new explicit confirmation in the bot before it is applied (silence does not count as consent).

We recommend reviewing the current version of the Terms from time to time.
